These Terms and Conditions ("Terms") govern your use of the website operated by Mike's Dryer Vent Pros ("we," "us," "our") and any dryer vent cleaning, inspection, repair, or related services we provide (collectively, the "Services"). By using our website, requesting a quote, booking an appointment, or receiving Services from us, you agree to these Terms. If you do not agree, do not use the website or our Services.
1. Services
We provide residential and light-commercial dryer vent cleaning, inspection, repair, rerouting, installation, and related services in Massachusetts, Rhode Island, and surrounding areas. Service availability, scope, and pricing are confirmed at the time of booking. We reserve the right to refuse or discontinue service at our discretion, including where job-site conditions present safety, structural, code, or access issues.
2. Estimates and Pricing
Estimates are based on the information you provide and typical conditions. Final pricing may change if actual conditions differ materially (for example, longer vent runs, hidden damage, roof access, animal nests, code violations, or required parts). We will communicate any change and obtain your approval before performing additional work that exceeds the original estimate.
3. Scheduling, Arrival Windows, and Cancellations
- Appointments are scheduled within arrival windows; we will make reasonable efforts to arrive on time but are not liable for delays caused by traffic, weather, prior jobs, or other circumstances beyond our control.
- You may cancel or reschedule at no charge with at least 24 hours' notice.
- Cancellations with less than 24 hours' notice, or no-shows, may incur a trip fee of up to $75.
- If we arrive and cannot perform the Services due to access issues, unsafe conditions, or your absence, a trip fee may apply.
4. Customer Responsibilities
- Provide accurate information about the property, appliance, and vent configuration at booking.
- Ensure safe, reasonable access to the dryer, vent termination, attic, basement, or roof as applicable.
- Disclose known issues such as past fires, damage, mold, pests, or prior repairs.
- Keep children and pets away from work areas during service.
- Be present (or authorize an adult representative) at the time of service.
5. Payment
Payment is due in full upon completion of the Services unless otherwise agreed in writing. We accept the payment methods identified at the time of booking. Past-due balances may accrue interest at the lesser of 1.5% per month or the maximum rate permitted by law, plus reasonable costs of collection (including attorneys' fees) to the extent permitted by law. Returned checks may incur a fee of up to $35.
6. Workmanship Warranty
We warrant our workmanship to be free from defects for thirty (30) days following completion of the Services. Our sole obligation under this warranty is to re-perform the affected portion of the Services at no additional labor charge. This warranty does not cover: (a) issues caused by improper use, lint buildup from continued use, or failure to follow our recommendations; (b) pre-existing conditions; (c) damage caused by pests, weather, or third parties; (d) parts or appliances supplied by you or others; or (e) any work performed by anyone other than us.
EXCEPT FOR THE LIMITED WARRANTY ABOVE, THE SERVICES ARE PROVIDED "AS IS" AND WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF IMPLIED WARRANTIES, SO THIS EXCLUSION MAY NOT APPLY TO YOU.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM. IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR PROPERTY DAMAGE ARISING FROM PRE-EXISTING CONDITIONS, CONCEALED DEFECTS, OR THE NORMAL OPERATION OF YOUR APPLIANCE AFTER SERVICE. NOTHING IN THESE TERMS LIMITS LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR ANY OTHER LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
8. Insurance
We maintain general liability insurance for our work. Proof of insurance is available on request. Any claim for property damage caused by our work must be reported to us within seven (7) days of the Service date so we can investigate.
9. Photographs and Marketing
We may take before/after photographs of work areas for service records, training, and marketing. We will not include personally identifying information (faces, addresses, identifying interior features) in any public marketing without your consent. You may opt out of marketing use by contacting us.
10. Website Use
All content on this website, including text, graphics, logos, and images, is owned by or licensed to us and is protected by U.S. and international copyright and trademark laws. You may view and print pages for personal, non-commercial use. You may not copy, modify, distribute, scrape, or use our content commercially without our prior written permission.
You agree not to use the website to: violate any law; transmit harmful code; attempt to gain unauthorized access; or interfere with the operation of the site.
11. Third-Party Services
Online booking is processed through Jobber and other third-party platforms. Your use of those platforms is governed by their own terms and privacy policies. We are not responsible for third-party services.
12. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Mike's Dryer Vent Pros and its owners, employees, and contractors from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.
13. Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. Any dispute arising out of or related to these Terms or the Services will be brought exclusively in the state or federal courts located in Massachusetts, and you consent to personal jurisdiction there. Nothing in these Terms waives any non-waivable consumer protection rights you have under the laws of your state of residence, including under Massachusetts General Laws Chapter 93A.
14. Severability and Entire Agreement
If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with any written estimate or invoice, constitute the entire agreement between you and us regarding the Services.
15. Changes to These Terms
We may update these Terms from time to time. The "Effective Date" above indicates the latest revision. Continued use of the website or Services after changes constitutes acceptance of the updated Terms.
